With 14 years and counting of experience of legal career, including her tenure as a prosecutor at the Miami-Dade State Attorney’s Office, Heloiza Correa asks to be a circuit judge.

Primary elections for this post will take place on August 20th.

-What are the good qualities of a judge?

A judge who treats everyone fairly and with respect, and who gives everyone an opportunity to be heard. A judged judge is a judge who’s going to follow the law, the way that it’s written. Patience is another quality. A lot of times, a judge is going to be approached with difficult cases where emotions are high. And a good judge needs to be able to control the emotions and the respect in the courtroom. But, at the same time, allow people to say their words. If people feel that they cannot communicate with the judge, they don’t feel heard. Hear both sides of the case and make decisions based on what the law is, as well as what are the facts that are being presented.

-If elected, what would your main duties be?

Give access to the court. I’m going to do my best to move cases along so that there are more hearing times available, and that people will have a quicker way of having their motions resolved. Miami-Dade County has a lot of cases, both in circuit court and in county court. If you have a situation where a judge is taking too long to rule, or you have a situation where a judge’s docket is very backed up because they have a lot of cases and cases that are not being pushed to be resolved, then it takes sometimes months for a simple motion to be heard in front of a judge. My number one goal is to try to move the cases along and to get rid of any sort of issues that have already been heard, or rule on any sort of issues that have already been heard or are pending that can be resolved in a timely manner. And if that involves me doing case management orders or having attorneys appear more frequently in front of me to resolve some of the older cases, then I will do that.

-The justice system can be complex. What do you have to say?

I understand why there’s a lot of people that feel that the justice system is complex. I think that it is part of a judge to go out into the community and inform and educate the community so they can understand what the proper procedures are to move cases along and what a judge can do and what a judge cannot do. I think that educating the public about how the justice system works is key to having people not be as scared of the justice system and to truly understand what it is that the judges are there to do. And it is the job of the judge to explain to those litigants if they are appearing without an attorney, or if they’re appearing alongside their attorneys to explain to them what it is that they are doing and forming to them the process and the procedure of these different hearings and what it is that they can consider and not consider when they’re making their rulings.

It’s very important for people to inform and educate themselves about the judges because they never know whether they’re going to be in front of a judge unexpectedly, or with their family members or friends who have to be in front of the judge, whether it’s a criminal case or a civil case or family. Voting the right judges that have experience, which have integrity and have a good reputation is key to making sure that the judicial system works properly, and that the best results and the quickest results are in fact reached.

Heloiza Correa: “Educar a la ciudadanía sobre cómo funciona el sistema de justicia es la clave”

Las elecciones primarias para este puesto se llevarán a cabo el 20 de agosto.

– ¿Cuáles son las mejores cualidades de un juez?

Un juez que trata a todos de manera justa y respetuosa, y que les brinda a todos la oportunidad de ser escuchados. Un juez consciente que siga la ley, la forma en que está escrita. La paciencia es otra cualidad. Muchas veces, a un juez se le presentan casos difíciles en los que las saltan las emociones. Y un buen juez necesita ser capaz de controlar las emociones y el respeto en la sala del tribunal. Pero, al mismo tiempo, que permita que la gente diga lo que quiera decir. Si las personas sienten que no pueden comunicarse con el juez, no se sienten escuchadas. Escuchar a ambos lados del caso y tomar decisiones basadas en la ley, así como en los hechos que se presentan.

-De ser elegida, ¿cuáles serían sus principales funciones?

Dar acceso a la corte. Voy a hacer todo lo posible para que los casos avancen y haya más tiempo de audiencia disponible. Que las personas tengan una manera más rápida de resolver sus mociones. El condado de Miami-Dade tiene muchos casos, tanto en los tribunales de circuito como en los tribunales del condado. Si se encuentra en una situación en la que un juez tarda demasiado en dictaminar, o en una situación en la que el expediente de un juez está muy atrasado porque tiene muchos casos, entonces demoraría meses para que una moción simple sea escuchada ante un juez. Mi objetivo número uno es tratar de agilizar los casos y deshacerme de cualquier tipo de cuestiones que ya se hayan escuchado, o pronunciarse sobre ellas o que estén pendientes y que puedan resolverse de manera oportuna. Y si eso implica que yo cumpla con las órdenes de administración de casos o que los abogados vengan más veces ante mí para resolver algunos de los casos más antiguos, así lo haré.

-El sistema de justicia suele ser complejo. ¿Qué puede decir?

Entiendo por qué hay mucha gente que siente que el sistema de justicia es complejo. Creo que el juez debe informar y educar a la comunidad para que puedan entender cuáles son los procedimientos adecuados y qué puede o no hacer un juez. Creo que educar al público sobre cómo funciona el sistema de justicia es clave para que la gente no le tenga tanto miedo y comprenda verdaderamente qué es lo que los jueces hacen. Y es trabajo del juez explicar a los litigantes, si se presentan sin abogado o si se presentan con abogados, cómo funciona el proceso judicial qué es lo que pueden considerar o no para tomar decisiones. Es muy importante que las personas se informen y se eduquen sobre los jueces porque nunca saben si van a estar frente a uno de ellos inesperadamente, o sus familiares o amigos, ya sea un caso penal o un caso civil o de familia. Votar a los jueces adecuados que tengan experiencia, integridad y buena reputación es clave para garantizar que el sistema judicial funcione correctamente y que, de hecho, se logren los mejores y más rápidos resultados.
